Stay on government's violative medical seat takeover order

Kochi: Kerala High Court on Friday stayed the government order declaring that admissions to all seats in self-financing medical and dental colleges would be done through the commissioner for entrance exams. A division bench comprising Justice K. Surendra Mohan and Justice Mary Joseph granted a conditional stay on a batch of petitions filed by the managements of medical and dental colleges challenging the state's order.

The court observed that admissions shall be made by the colleges only from the rank list of NEET on the basis of inter se merit from among the applications received by each college. The colleges shall submit a prospectus for the approval of the admission supervisory committee. The committee should complete the approval process within three days from the submission of prospectus. The court said that the government order is in violation of the apex court directives and asked the government why it had passed an order without reaching an agreement with the managements.

The managements argued that they had started the admission process to the MBBS & BDS seats in their colleges as approved by the admission supervisory committee. They said the government order passed on August 20 based on the directions of the central government was illegal. They contended that there was no such direction in the letter sent by the centre. The letter only said that it was desirable to have a centralised allotment by the state, the managements said.
