Approach Bombay High Court for bail, Supreme Court tells Purohit

Petitioner said he is in judicial custody for the past 7 yrs and 5 months without the investigation agency having filed a charge sheet.

New Delhi: The Supreme Court on Friday asked Lt. Col Purohit, accused in the Malegaon blast case to approach the Bombay High Court for bail and stay of trial.

A Bench of Justices S.S. Bobde and Arun Mishra permitted the petitioner to withdraw the writ petition with liberty to seek remedy in the High Court.

The Petitioner said he is in judicial custody for the past 7 years and 5 months without the investigation agency having filed a charge sheet.

He said initially the investigation in the criminal case was investigated by the Anti Terrorist Squad of Maharashtra. The ATS has purportedly completed the investigation and had filed the Final Report under Section 173 of the Cr.P.C in the year 2009 itself. However, the Central Government shifted the probe to the NIA.
