Chennai: The Madras high court has reiterated that due to pending examination of the amendments to the rules, no precipitative action will be taken, subject to the advocates and/or Bar associations withdrawing the boycott and resuming work immediately, failing which necessary action would follow.
A resolution to this effect was passed by the Judges (Full Court) at the meeting held on Thursday, a copy of which was sent by T. Ravindran, Registrar, high court, to D. Selvam, Chairman, Bar Council of Tamil Nadu and Puducherry.
“The Full Court reiterated that the Chief Justice’s assurance to representatives of Bar Council and Bar Associations that pending examination of the rules, no precipitative action will be taken, will continue to operate, subject to the advocates and/ or Bar Associations withdrawing the boycott and/or the strike and resuming work forthwith, failing which, necessary action, as per norms already laid down, would follow”, it read.
According to the resolution, the Full Court, in the meeting held on June 16, felt that the extant rules thus framed were only in reference to the acts of omission and commission in the court and within its precincts, and that section 34 can be invoked by the high courts even without framing the rules. The resolution said, “The Full Court has decided that the suggestions so submitted, be examined by a committee to suggest amendments to the act and representatives of the Bar be heard.”
