Kochi: The Kerala High Court has dismissed IG T.J. Jose's petition against the MG University's decision to debar him for copying during the LLM exams.
An enquiry report had recommended cancelling all exams he took in April/May 2015 and prohibit him from appearing for any of its exams before May 2016.
He argued that the decision was against all procedural formalities as he was denied an opportunity to file an objection to the show cause memo and enquiry report.
A.C.Babu, the joint registrar, conducted a preliminary inquiry on vice-chancellor's order immediately after receiving a report from the chief superintendent that the IG used bits to cheat in the exam. Later Syndicate Standing Committee on Students Disciplinary Welfare and Grievance confirmed this.
The court found that there was a detailed enquiry the Syndicate panel consisting of several members. They have taken the statements of many involved.
The petitioner argued that he didn't get copies of their statements. The court, however, observed otherwise.
"This is not a service matter, and when an enquiry is conducted by the university through competent officers, they take statements from various persons to find out the actual issues involved," it held.
