HC stays order seeking tax offender's passport

Hyderabad: The vacation division bench of the Telangana High Court suspended an order of a single-judge bench, requiring a person to deposit a renewed passport with the criminal court.

The bench was dealing with an appeal filed by Bhanu Reddy Gopu, who complained that his online application for passport renewal was rejected on the grounds of a pending criminal case. He also contended that this prevented him from travelling abroad. The single judge, while allowing the petition, had made clear that the application for renewal of his passport shall be considered dehors the pendency of a criminal case in the court for economic offences. The petitioner is alleged to be arrayed as an accused for non-filing of tax returns as a director of a company. While directing consideration of renewal of his passport, the judge had imposed the condition that the passport be deposited with the criminal court. The bench suspended the order, but made it clear that he shall travel abroad only with the consent of the criminal court.

No relief for student from loan recovery

The vacation bench of the Telangana High Court, dealing with a writ petition filed by a medical student challenging coercive steps taken by Mahesh Cooperative Urban Bank to recover monies, did not grant relief to petitioner M. Annie Rose. She obtained a loan from the said bank and is currently pursuing an undergraduate course in medicine at a Philippines college. Effectively, the order of the Debt Recovery Tribunal made on March 10 was not stayed.

Warrant against heart patient stayed

The same bench stayed a non-bailable warrant (NBW) issued against I.V.S.N. Raju, for non-compliance with a decree of the State Consumer Forum. It was argued before the bench that Raju was a heart patient and therefore, the NBW should be recalled. Under the law, the non-execution of a decree under the Consumer Protection Act logically leads to an execution petition entailing the issuance of a warrant.
