Man sexually assaults differently abled woman, gets 7-year RI

The judge said based on false promise he had sexual intercourse with her several times.

Chennai: The Mahila court in Chennai has sentenced a 39-year old person to undergo rigorous imprisonment for seven years on charge of sexually assaulting a differently abled woman for four years. They met each other with the help of matrimonial advertisement in a website, OLX.com.

According to prosecution, differently abled-woman Pasamalar, 34, (name changed) of Tiruvannamalai completed M.A. B Ed, M. Phil and diploma in cooperative management.

Subsequently, she was pursuing Ph.D and working in a private company in MEPZ, Tambaram sanatorium. On behalf of Pasamalar, her brother published a matrimonial advertisement in OLX.com seeking suitable bridegroom. N. Balasubramanian, 39, of Ambal Nagar, Ekkaduthangal, who was working in a private company as a credit officer, published a similar advertisement on the website.

Balasubramanian, also differently-abled person, contacted Pasamalar and assured her that he would marry her. Soon, they became friends. On June 26, 2012, he took her to his room in Ambal Nagar and gave her a cool drink. After drinking it, she lost her consciousness and next day she woke up and realised that she was sexually assaulted by Balasubramanian.

Later, he had sexual intercourse with her assuring that he would marry her soon. Weeks later, she became pregnant and both went to a hospital and aborted the pregnancy.

Following this, he refused to marry her. Based on a complaint, all women police, Guindy, registered a case against Balasubramanian on charge of raping and cheating her.

During the trial, Balasubramanian denied the allegations and said police foisted case against him. On completion of trial, Mahila court judge R. Kalaimathi said a victim of sexual assault does not make up a false story. It will be difficult to secure alliance and society would look down at her. The judge sentenced him to seven years’ rigorous imprisonment and imposed on him a fine of '10,000.
