Madras High Court judge puts severe restrictions on temple fest

“Mere apprehension cannot be a ground to reject the representation”
Chennai: Imposing several conditions, the Madras high court has granted permission to the residents of a village in Namakkal district to organise a cultural event during the temple festival.
Laying down various conditions, Justice M.M. Sundresh said there should not be any obscene dance or vulgar dialogues during the performance. Double-meaning songs should not be played. No dance or song, touching upon any political party or religion or community or caste be played. No flex board in support of any political party or communal leader should be erected. The function should not affect either religious or communal harmony and shall be conducted without any discrimination based on caste, the judge said.
In the petition, D. Damodharan of Theedalat Thondikaradu, Tiruchengode, submitted that the local residents proposed to celebrate festival at Thondikaradu Sri MahaMariamman Temple on Oct. 31. They have made elaborate arrangements. On Oct. 3, 2015, he sent representations to SP, Namakkal, DSP, Tiruchengode and Inspector of Police, Tiruchengode, seeking permission. As there was no response, the present petition seeking direction to police to consider the representation and to give permission for the cultural event, was filed.
Additional government pleader, S. Diwakar, submitted there is a likelihood of law and order problem if permission is granted. The judge said “Mere apprehension cannot be a ground to reject the representation”. He said the petitioner should be permitted to conduct the cultural programme between 6.00 pm and 10.30 pm.
