Madras High Court directs appearance of CMDA officials in contempt case

The petitioner was one among 23 allottees of shops at Koyambedu Food Grain Complex
CHENNAI: The Madras high court has ordered statutory notice to Karthik, Member Secretary of Chennai Metropolitan Development Authority (CMDA) and Kiran Gurrala, Chief Executive Officer of CMDA, for their appearance on September 14 in connection with a contempt of court case. Justice N. Kirubakaran ordered notice on a contempt petition from N. Rajmohan which sought to punish the two officials for having committed contempt by disobeying a court order of August 10.
The judge said the petitioner was one among 23 allottees of shops at Koyambedu Food Grain Complex in the category of Non George Town Traders Type-I, which allotment was subsequently cancelled by the CEO, CMDA, by an order of June 30 this year. Challenging the same, a petition was filed. Pending disposal of the petition, a miscellaneous petition was filed to direct the authorities to allow all the 23 cancelled allottees to participate in the draw of lots to be held on August 11.
On August 10, the court directed the Member Secretary and CEO of CMDA to permit all the 23 cancelled allottees to participate in the draw of lots to be conducted on August 11 and further observed that the permission granted was subject to the result of the petition.
Alleging that the court direction had been violated by the two officials, the petitioner had filed the present contempt petition. The judge said M. Rajasekhar, petitioner’s counsel submitted that the draw of lots was held as scheduled. But, in spite of the information given by the petitioner by a letter of August 10, which was received on the same day by the two officials, all the 23 cancelled allottees, including the petitioner, were not allowed to take part in the draw of lots.
