Madras High Court helps man who had passed class 4 to get job

The petitioner’s case was that his mother was employed in Tangedco
Chennai: Coming to the rescue of a person, who was denied employment on compassionate grounds by Tangedco since he had not passed Class 8, the Madras HC has directed the company to provide suitable employment to him based on his Class 4 qualification.
Allowing the petition from Thirumaniraja, Justice D. Hariparanthaman said that considering the facts and circumstances of the instant case and in the light of his earlier judgment, he was inclined to allow the petition.
The petitioner’s case was that his mother was employed in Tangedco. She died on July 17, 2012 while in service leaving behind him, his younger brother and a sister as legal heirs. His father predeceased his mother. He studied only up to Class 4. While so, he applied to Tangedco for a suitable job on compassionate ground this year. But, his application was rejected on the ground that he had not passed Class 8. Hence, his present petition.
Setting aside the rejection order, the judge said the service regulations governing Tangedco employment provided for a pass in Class 5 for appointment to certain posts as educational qualification. Moreover, the same regulations provided not even a pass in Class 4 as the required qualification for certain posts and required only ability to read and write Tamil. Further, contract labourers were absorbed without insisting on educational qualification.
