Hyderabad High Court stays co-opted members

Co-option of 4 members illegal, say petitioners

Hyderabad: Justice M.S. Ramachandra Rao of the Hyderabad High Court on Friday granted stay on functioning of the persons who were co-opted as members of the Kamareddy municipal council on July 30.

The judge granted orders on a plea by Syed Massod Ali and others. They isubmitted to the court that the municipal chairman had adjourned the general meeting held on July 30.

In that meeting, elections could not be held as there was need for a special meeting to conduct election for co-option.

After the municipal chairman left the meeting hall, a group led by the TRS leader held a meeting on their own and declared that they had elected the co-opted members.

N. Krishna Mohan Rao, Afsari Begum, Mohamm-ed Khadir and Mohammed Sajid were co-opted by the council. The petitioners moved the court contending that co-option of the four members was illegal.

The municipal commissioner sought clarification on the issue. However, the government had declared that the election was valid which is against the law.

The judge felt that the proceedings on July 30 were not as per law and legality of a memo issued the government has to be examined.

The co-opted members were directed not to discharge functions as members of municipal council till further orders.
