Attempting suicide may not be a crime

Critics say it is cruel because it provides double punishment for a troubled individual
New Delhi: The Union home ministry is in the process of removing Section 309 of IPC, under which attempting to commit suicide is punishable with a jail term of upto one year and fine, and discussions in this effect are on.
Minister of state for home Kiren Rijiju said in Lok Sabha that the Law Commission in its 2010 report on “Humanisation and Decriminalisation of Attempt to Suicide” had recommended that Section 309 of IPC needs to be deleted from the statute book.
Responding to a query by the MHA some time back, several states have sent their comments concurring with the recommendation of the Law Commission.
The panel had also argued that attempting suicide was “manifestation of a diseased condition of mind” that called for treatment. Critics say that it is cruel and irrational because it provides double punishment for a troubled individual.
Meanwhile, the Union government on Tuesday said that it has no proposal to abolish capital punishment in the country.
“At present, there is no proposal in MHA to amend the Indian Penal Code, 1860 to abolish capital punishment in the country,” minister of state for home Kiren Rijiju informed the Lok Sabha.
