Title of Beverly Hills Owners Assn at Khajaguda Challenged
Hyderabad: The Telangana High Court will continue hearing a writ plea regarding a dispute over a land parcel situated in Khajaguda, Serilingampally mandal, over ownership rights against Beverly Hills Owners Welfare Association. Justice K. Lakshman accepted a writ plea filed by Syed Ghouse Mir Khasim Ali and Syed Basheer Aksari Begum, who claimed that their names had been recorded in revenue documents, including Kasara Pahanies, for 1954-55 and Sessala Pahanies for 1955-58, which are fundamental revenue records establishing their ownership.
The petitioners argued that the Association had previously admitted their ownership, further strengthening their claims. However, they contended, despite these records, the Chief Commissioner of Land Administration (CCLA), through proceedings dated June 12, 2024, erroneously rejected their ownership claims and directed them to seek civil remedies.
The petitioners contended that the land could not be traced to the late Yasin Khan and late Hyder Mir Ali Khan, whose names appear on the Dharani portal, thereby overlooking their established ownership rights through their late father, Syed Ahmed. The petitioners alleged that multiple fraudulent transactions had been carried out by the Beverly Hills Owners Welfare Association, including joint development agreements, irrevocable general power of attorneys, sale deeds, gift deeds and release deeds. The petition detailed over 40 such agreements executed between 2021 and 2024, which the petitioners claimed were created without legal entitlement.
They sought to have these documents declared null and void, contending that the rights to the land belonged exclusively to them. The petitioners also sought a directive to the Hyderabad Metropolitan Development Authority (HMDA) and the Greater Hyderabad Municipal Corporation (GHMC) to refrain from granting building permissions related to the disputed land. Additionally, they sought to overturn the findings of the CCLA, arguing that they were contrary to the facts and legal position. The government pleader, appearing for the HMDA metropolitan commissioner and GHMC authorities, sought time to get instructions on the matter. Accordingly, the judge posted the matter for further adjudication.
Illegal rent collection from Tappachiputra dargah alleged
The Telangana High Court entertained a plea challenging the illegal rent collection by the project officer of the Child Development Project from an Anganwadi located on Waqf land, Dargah Gunj-e-Shaheedan, at Tappachabutra. The judge was dealing with a writ plea filed by Mohammed Ismail Ashrafi. The petitioner contended that a representation was addressed to the authorities in this regard which was in vain. The petitioner, who served as mutawalli (caretaker), alleged that the private respondents were collecting rent from the Anganwadi without his knowledge or consent and failed to pay the due rent to him. The petitioner sought a direction against authorities to consider his representation made on November 8, 2024. The judge accordingly ordered notices to the respondents.
PIL for action in rape cases
A two-judge panel of Telangana High Court on Monday directed the government to respond to allegations of inaction in dealing with increasing rape cases in the state, as a final chance. A panel of Justice Sujoy Paul and Justice G. Radha Rani heard party-in-person Dr K.A. Paul sought a speedy trial of various rape cases. He sought the constitution of a special court for the purpose. The petitioner sought direction to the National Commission for Women to conduct an investigation into the systemic failures leading to increased crime against women and for necessary changes in the law. Safe accommodation for rape victims was another prayer of the petitioner, who volunteered to offer free space at his Paul’s Charity City near Sangareddy, having 1,200 rooms spread over 300 acres.
