RERA Slaps Rs 38 Lakh Fine On Countryside Realtors
Telangana Real Estate Regulatory Authority (TGRERA) has imposed a penalty of `38.59 lakh on Countryside Realtors, run by Simha Kavi Narasimham and Mohd. Masood Ul Hasan, for misrepresenting the status of permissions and approvals for their “Westend Greens” villa project in Mokila.
Hyderabad: The Telangana Real Estate Regulatory Authority (TGRERA) has imposed a penalty of Rs 38.59 lakh on Countryside Realtors, run by Simha Kavi Narasimham and Mohd. Masood Ul Hasan, for misrepresenting the status of permissions and approvals for their “Westend Greens” villa project in Mokila.
The RERA found that the company had falsely marketed the project as a fully HMDA-approved gated community, despite possessing only limited permission for an open plotted layout and three model villas.
The complainants, all villa owners in Westend Greens, were represented by Counsel A. Chandra Shekar and G. Venugopal. They stated that they had paid for facilities such as a clubhouse, sewage treatment plant (STP), and water supply systems. They alleged that not only were these facilities not provided, but the developers had also intimidated the buyers by sending legal threats.
The RERA bench observed that Countryside Realtors had violated Sections 11 and 14 of the RERA Act by providing misleading information and failing to complete the promised amenities. It also noted that the company had constructed 39 villas without obtaining the necessary building permissions.
“The Respondents are strictly restrained from marketing or selling any plots or villas without obtaining proper permissions and RERA registration,” the order stated. It directed Countryside Realtors to pay Rs 38,59,436 within 30 days.
The Authority also instructed the developer to approach HMDA and secure the necessary approvals to complete the project.
Importantly, RERA further stated that if Countryside Realtors fails to obtain the required permissions, they must refund the entire amount collected from homebuyers, along with compensation for the inconvenience and financial hardship caused.
