HC Allows DMK to File Defamation Suits Against TN Ministers
However, senior advocate J. Ravindran who appeared for the DMK contended that such a notice was not required in the present case since the party is challenging the defamatory statements made by the ministers and not something done in their official capacity.
Chennai: Madras high court on Monday allowed an application by the DMK seeking leave of the court to sue state ministers Aadhav Arjuna and C.T.R.Nirmal Kumar for alleged defamatory statements connecting the DMK leaders with the Pocso case involving ‘Gem Granites’ Veeramani.
When the petition came up before Justice Govindarajan Thikakavadi, Advocate General Vijay Narayanan argued that no notice could be instituted unless the mandatory notice under section 80 was issued since Aadhav Arjuna and Nirmal Kumar had been made party in the case in their capacity as public officers. However, senior advocate J. Ravindran who appeared for the DMK contended that such a notice was not required in the present case since the party is challenging the defamatory statements made by the ministers and not something done in their official capacity.
