Mumbai court clears extradition proceedings against Lalit Modi
Mumbai: A special Prevention of Money Laundering Act (PMLA) in Mumbai has allowed for issuance of letter of request to extradite former IPL chairman Lalit Modi from the United Kingdom.
The decision comes after the Enforcement Directorate (ED) moved a plea in front of the special court to extradite Modi. ED requested permission for issuance of a letter under the Mutual Legal Assistance Treaty, to a competent court in the United Kingdom to bring back Modi to India for probe.
ED had earlier argued that the agency had been unable to execute the non-bailable warrant against Modi as he is residing in UK.
The case pertains to a criminal complaint filed by BCCI which has accused the former IPL commissioner of misappropriating funds during his tenure.
ED in its application said, "The ED is the sole investigative agency under the Ministry of Finance, Department of Revenue, Government of India, for conducting investigations under the provisions of PMLA against money laundering offences.
"This application is filed with a prayer for issuance of a letter of request to the competent authority in the government of United Kingdom for mutual legal assistance for the execution of the open ended non-bailable warrant (NBW) dated August 6, 2015, issued by the PMLA court against Lalit Modi, which is judicial document and for the transfer of the suspected accused person to India."
