TGHRC Recommends Compensation, Employment to Husband in Tubectomy Death Case

The Commission recommended payment of an additional Rs.8 lakh as compensation and further advised providing suitable employment to the husband to enable the family to live with dignity

Hyderabad: The Telangana Human Rights Commission (TGHRC) Chairperson Dr.Justice Shameem Akther, held the Telangana government vicariously liable for medical negligence leading to the death of M. Lalitha after a tubectomy surgery conducted at a Government Community Health Centre in Wanaparthy district in July 9, 2017.

The Commission found that ileal perforation during surgery and delay in detection caused septic peritonitis and cardio-pulmonary arrest, rejecting the claim of mere physiological complications.

Observing that the earlier payment of Rs.2 lakh was wholly inadequate, especially in view of the disabled husband and two minor children of the deceased, the Commission recommended payment of an additional Rs.8 lakh as compensation and further advised providing suitable employment to the husband to enable the family to live with dignity.

In the complaint filed on July 10, 2017, the complainant said his village Asha worker Chandrakala took his sister-in-law Lalitha to the Government Hospital and admitted her for undergoing Tubectomy surgery, without the consent of the family.

The next day of operation, her stomach got swollen and she started facing inconvenience. On seeing the swelling, the doctor who conducted Tubectomy operation on the deceased referred her to Government Hospital in Wanaparthy and from there, she was again referred to Osmania General Hospital, Hyderabad where she died on July 9, 2017, while undergoing treatment.

The complainant alleged that despite lodging a complaint with police, and the Collector, Wanaparthy district, no action has been taken. Stating that Lalitha has two minor children, the complainant requested the Commission to take action against the persons responsible for her death.
