Telangana HC Declines To Stay Civil Court Order on Bathukammakunta Lake
Court directs petitioner to approach vacation bench; says lake is a heritage site, not private land

The Telangana High Court on Friday was not inclined to interfere with the civil court orders in regard to the Bathukammakunta at Amberpet. However, the court directed the private parties to approach the vacation bench for relief.
On April 22, the City Civil Court had dismissed a civil suit by A. Sudhakar Reddy, who claimed the ownership of the land of around seven acres, in which the lake is situated. The court opined that the lake was a heritage site and not a private reservoir.
Challenging the same, Sudhakar Reddy approached the High Court. He also requested the court to stop the works carried by HYDRAA. Government counsel submitted that the land was mentioned as lake land in its records and that private parties had filled up the land with debris and tried to take possession with fabricated documents.
A division bench of the High Court comprising Justice Moushumi Bhattacharya and Justice B.R. Madhusudhan Rao, after considering questions raised on behalf of the parties regarding the ownership of the land and the time required to ascertain these issues, gave liberty to Sudhakar Reddy to approach the vacation bench for relief.
