SC Declines Interference In Raidurgam Land Auction

Hyderabad: The Supreme Court on Friday declined to intervene in the proposed auction of around 11 acres of land in Survey 83/1 of Raidurg Pan Maktha in Telangana, leaving it open to the petitioner to pursue the dispute before the Telangana High Court. A three-judge apex court bench headed by Chief Justice of India Justice Surya Kant made it clear that any grievance concerning the auction could be adjudicated by the High Court.
The Telangana Industrial Infrastructure Corporation (TGIIC) had issued a notification proposing to auction land spread across two survey numbers at Raidurg, Pan Maktha. The upset price has been fixed at Rs 175 crore per acre.
Some private parties had earlier approached the Telangana High Court by claiming rights over the land and had submitted that the issue was pending before the Land Reforms Tribunal. The Telangana High Court had refused to stay the auction of land.
Juvvadi Pranaya Simha Rao approached the Supreme Court challenging the auction notification. Appearing for the petitioner, senior counsel Neeraj Kishan Kaul referred to the Supreme Court's earlier orders concerning the Kancha Gachibowli land and submitted that land which were directed to be protected was now being put up for auction.
Senior advocate Abhishek Singhvi, appearing for the Telangana government, submitted that the petitioner was seeking to create a misleading impression by linking the auctioned land with the Kancha Gachibowli property. Singhvi told the bench that the land covered by the present auction notification had no connection with the Kancha Gachibowli site and was located nearly five kilometres away.
After considering the rival submissions, the bench declined to intervene with the TGIIC notification. The bench indicated that any dispute relating to the auction could be raised before the Telangana High Court and accordingly declined to proceed further with the petition.
