RERA Orders Builder to Hand Over Villa
Builder faces penalty for RERA violation and subjecting buyers to mental trauma

Hyderabad: A couple approached the Telangana Real Estate Regulatory Authority (RERA) against Sankalp Infra Projects Pvt. Ltd, after not getting possession of a villa bought nearly nine years ago. The buyers had purchased Villa No. 113 in the Aakriti Viva Project by Sankalp Infra Projects in October 2014. The builder promised to hand over the villa by April 30, 2016.
According to the complainants, they made most of the payment as per the agreement, but the villa was never finished. Instead, the builder demanded extra money and cancelled the sale agreement. They also allege that the developer had tried to deposit their cheques years after the agreement and ignored their repeated follow ups leading to financial stress and mental trauma.
The builder claimed that the buyers did not pay the full amount, which gave the company the right to cancel the agreement. The builder also argued that the issue should be settled through arbitration.
The RERA, however, ruled that the builder’s move to cancel the sale was not valid because the buyers had only a small amount pending. RERA directed the developer to complete the villa and hand over possession. The authority also imposed penalties on the builder for not registering the project under RERA, which is required by law.
