Owaisi Slams Centre Over PM, CMs Removal Bill

Asaduddin warned that the provisions of the Bill can result in law enforcement agencies being misused to file cases against elected representatives and remove them from office on flimsy ground

HYDERABAD: The AIMIM president and Hyderabad MP, Asaduddin Owaisi, on Wednesday castigated the move by the BJP-led government at the Centre to amend the Constitution with laws proposed to remove from office any chief minister or prime minister if they are detained 30 days or more in any case.

Slamming the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025 introduced in the Lok Sabha by Union home minister Amit Shah, Asaduddin warned that the provisions of the Bill can result in law enforcement agencies being misused to file cases against elected representatives and remove them from office on flimsy ground.

He told reporters that even the BJP which introduced the Bill, will not forever be in power.“The automatic removal of CMs or PM on flimsy grounds will make governments accountable not to the people or legislatures, but to Union-controlled executive machinery,” Asaduddin said.

He said fear of arbitrary detention can deter ministers and chief ministers from performing their constitutional duties, and the law, if enacted, will embolden bureaucrats to resist legitimate directions, leading to administrative paralysis. The proposed laws can lead to removal from office of elected representatives merely on the basis of detention without trial. This is a violation of the principle of separation of powers, as they allow executive agencies to act as judge, jury, and executioner,” Owaisi warned.

The Bill, he said, dilutes parliamentary democracy and weakens judicial safeguards by empowering unelected officials and the AIMIM firmly opposed to the Bill.
