Hyderabad:In interim relief to Mylan Laboratories Ltd, on which the on Wednesday directed the Pollution Control Board (PCB) not to take coercive steps till further orders against Mylan Laboratories Ltd. The board had passed closure orders following a fire accident on May 5.
The court issued the interim relief as the the R&D wing of the pharma unit had to maintain chemicals at very low temperature, and under supervision. The court also stopped the electricity department from disconnecting power supply to the unit. The bench comprising Justice Pulla Karthik and Justice Nandikonda Narsing Rao was dealing with a petition filed by Mylan Laboratories challenging the closure orders issued by the PCB.
Senior counsel S. Niranjan Reddy, appearing for the petitioner company, argued that PCB had no right to issue such orders. The PCB only has authority to interfere in issues related to air and water pollution. He submitted that the company had obtained fire safety no-objection certificates. The factories department, the authority to oversee fire and other safety measures, had issued notice to the company to not use the floor where the fire accident occurred.
Zeeshan Adnan Mahmood, appearing for the PCB, argued that running of the unit would be hazardous and another calamity could occur.
