20,000 Families In Malkajgiri Complain Of Wakf Classification

HYDERABAD: Around 20,000 families across 76 colonies in Malkajgiri have raised serious concerns after over 300 acres of land was listed as Waqf Board property in Malkajgiri constituency last year. As a result, banks have not been approving home loans and property owners expressed their inability to carry out transactions like sales or gift deeds for urgent needs, leading to financial and mental distress.
According to residents, 300 acres of land within the Malkajgiri constituency limits were listed as Waqf Board property in November 2024. The same land was also included in the prohibited list under Section 22A of the Registration Act, 1908.
Speaking to Deccan Chronicle, BT Srinivasan, General Secretary of Federation of Resident Welfare Associations, Malkajgiri said, “We are worried a lot as the land was recorded as the Waqf property. We have pahani land records from the 1950-60s. We have been paying property taxes for years but facing issues with regards to land registration".
Another Malkajgiri resident Sampath Yadav said the residents were not given gazette notification but around 300 acres have been placed under prohibition.
"Earlier, there were such claims, and when we challenged them in court, more properties were added in the meantime. There have been no property sales in this area since 2017, and anyone who wants to construct a house is approaching Highcourt for directions,” he said.
Given the issues, property owners who met minority welfare minister Mohammed Azharuddin on Friday submitted a representation highlighting key issues, including land, concerning the constituency.
Keeping the welfare of the people in view, Malkajgiri MLA Rajashekhar Reddy who was part of delegation requested removal of these lands from the purview of Section 22A of the Registration Act, 1908 and provide justice to the property owners.
The minister, according to the property owners, responded positively and assured that the issues would be examined and appropriate action be initiated.
According to Telangana Waqf Board elected member Abul Fateh Syed Bandagi Badesha Quadri, the Supreme Court recently gave directions stating that the titled deed is not an ownership document.
“Once the properties are notified under the gazette after completing the due procedure of law, the survey commission will submit the report and the gazette will be printed. Waqf is always Waqf. Even if people do sale deeds, gift deeds or registrations that will not change the status of the Waqf property,” he added.
