SC faults AP HC, orders fresh hearing on Vallabhaneni’s bail plea

Vijayawada: The Supreme Court on Thursday set aside the anticipatory bail granted to former MLA Vallabhaneni Vamsi Mohan by the Andhra Pradesh High Court in an illegal mining case.

A division bench comprising justices Sanjay Kumar and Satish Chandra Sharma held hearing in the case as the AP government challenged the High Court's grant of pre-arrest bail to the former legislator.

The apex court faulted the High Court for not adequately considering the submissions of the AP government. On behalf of the investigators, senior counsel Sidharth Luthra argued that Vallabhaneni was a key figure in the alleged mining scam and his custodial interrogation was needed. The apex court directed the AP High Court to conduct a fresh hearing in the case and take a decision based on the merits.

The AP government, represented by advocate Mukul Rohatgi, submitted to the court that a counter affidavit will be filed in a week's time. The apex court directed the AP High Court to conclude hearings in the case and deliver the verdict within four weeks from the time of submission of the counter.

Vallabhaneni is an accused in the Rs 196-crore illegal mining case.
