Land use rules: AP to cancel alienation of 15.17 acres land to Suresh Productions in Visakha

The Andhra Pradesh government has decided to cancel the alienation of 15.17 acres from the 34.44 acres allotted to M/s Suresh Productions Private Limited due to the firm's deviation from the original purpose of land allocation.

Vijayawada:The Andhra Pradesh government has decided to cancel the alienation of 15.17 acres from the 34.44 acres allotted to M/s Suresh Productions Private Limited due to the firm's deviation from the original purpose of land allocation. It has directed the Visakhapatnam district collector to serve a show-cause notice to the firm and provide a reasonable time for it to present its case before making a final decision.

Revenue special chief secretary R.P. Sisodia issued directives following detection of violation of land alienation conditions by Suresh Productions in Madhurawada village, Visakhapatnam rural mandal, recently.

The state government had originally allotted 34.44 acres in survey no. 336 (part) to Suresh Productions to set up a film studio and allied industries through GO 963 dated 13-09-2003 with the aims to promote film industry and generate employment.

However, the company wrote to GVMC on March 2023, seeking approval for a residential layout covering 15.17 acres in the allotted land. A no objection certificate from the district collector is pending.

The state government feels this was a violation of the board’s Standing Order 24. As per this, only the state government has the authority to modify the land’s purpose and not at the district level.

Citing the Supreme Court’s decision in State of UP vs Zaheer Ahmad, the AP government laid stress on its right to cancel land allotments if conditions were breached or misrepresented.

The government decided to cancel the alienation of 15.17 acres from the total 34.44 acres land assigned to the company and the remaining land will be allotted to continue under the original terms provided there are no further violations. Any future breaches would be dealt with under BSO-24 regulations, the firm has been warned.

The government directed the Visakhapantam district collector to issue a show cause notice to the company and give a reasonable time to present its case before a final decision is taken. In addition to this, the Visakhapatnam Metropolitan Region Development Authority commissioner and GVMC commissioner were advised to reject any application from the company seeking a change in land use.
