HC Reserves Verdict On PIL To Stall Election Process

A division bench comprising chief justice Lisa Gill and justice Challa Gunaranjan on Thursday heard the PIL filed by Dr Ch Ravi Kumar stating that this would “cause more harm to the BCs.”

Vijayawada:The Andhra Pradesh High Court heard a PIL seeking stalling of the election process for local bodies on the plea that the reservation provided to the backward classes was against the verdict of the Supreme Court, and reserved the verdict.

A division bench comprising chief justice Lisa Gill and justice Challa Gunaranjan on Thursday heard the PIL filed by Dr Ch Ravi Kumar stating that this would “cause more harm to the BCs.”

Petitioner's counsel Vivekananda Virupaksha argued that the state government had not disclosed the details of the report from Rajiv Ranjan Mishra, who was appointed to finalise the reservation for BCs.

Counsel submitted that fixing reservations without having proper data would affect the STs, SCs and BCs and sought a stalling of the election process.

The advocate general on behalf of the state government, Dammalapati Srinivas, argued that once the notification for conduct of local body elections was issued by the SEC, the courts were not supposed to interfere with it.

AG felt the PIL lacked eligibility for hearing. He submitted that based on the directions from both the HC and Supreme Court, they had fixed reservations below 50 per cent for all and pleaded that the PIL be dismissed.
