Amaravati: In a significant development, Gade Vijayalakshmi, the mother of G Sai Krishna, who went missing from the Krishna Lanka Police Station, on Tuesday informed the Andhra Pradesh High Court that she is withdrawing her interlocutory petition seeking a CBI probe into her son’s disappearance.
It may be recollected that Vijayalakshmi had earlier filed a habeas corpus petition in the High Court over Sai Krishna’s disappearance after he was taken into custody by suspended CI SSVV Nagaraju in May. Along with it, she also filed an interlocutory petition on June 27th requesting that the investigation be transferred to the Central Bureau of Investigation. The petition claimed Sai Krishna was taken into police custody at Markapuram on May 6 and illegally detained at Krishnalanka police station without being produced before a magistrate within 24 hours. It further alleged that CCTV footage was deliberately deleted to conceal custodial torture and his subsequent death.
The CBI on Monday filed a counter-affidavit in the AP High Court regarding the Public Interest Litigation (PIL) seeking to transfer the Gade Sai Krishna disappearance case to the CBI. In its submission, the CBI stated that the case does not have any interstate or international implications. CBI officials also informed the court that the AP government is currently investigating the case under the supervision of an IG-level officer. Citing several past Supreme Court judgments in their counter, they recalled that the apex court has made it clear that cases should be transferred to the CBI only under the most exceptional circumstances.
Additionally, the CBI officials requested that if the court feels it is necessary to transfer the case to the CBI, the state government should be directed to provide the required manpower, technical resources, and other necessary support to conduct the investigation.
The main habeas corpus petition and the related pending petitions are listed for hearing in the High Court on Wednesday.
