Court Dismisses Daughter Dr. Sunita’s Plea For Further Probe Into Viveka Murder Case

Anantapur: Principal Special Judge for CBI Cases, Hyderabad, on Friday dismissed a petition filed by Dr. Sunita Narreddy, daughter of former minister Y.S. Vivekananda Reddy, seeking further investigation into the alleged role of Y. Kiran Yadav and S. Arjun Reddy in the murder of Vivekananda Reddy.
Principal Special Judge K. Pattabhi Rama Rao underlined that a second petition seeking further investigation into the murder is not maintainable under the circumstances of the case. It observed that the petition filed under Sections 190 and 200 of the Code of Criminal Procedure (CrPC) could not be treated as a private complaint, as the relief sought is primarily for further investigation.
The judge observed that the court cannot direct the CBI to investigate the case in a particular manner, examine specific witnesses, or draw particular inferences from material already collected during the investigation. He remarked that the petitioner is, in effect, seeking a reinvestigation or fresh investigation into facts that have already been examined by the agency.
Pattabhi Rama Rao pointed out that the investigation cannot continue indefinitely, particularly in view of the Supreme Court's direction to expedite the trial. He maintained that while certain aspects of the investigation have not been examined in detail, it is not within the court's jurisdiction to direct the investigating agency to pursue a particular line of inquiry.
Dr Sunita had sought further investigation into the communications between Kiran Yadav and Arjun Reddy around the time of Vivekananda Reddy's murder at his residence in Pulivendula on March 15, 2019.
Earlier, the CBI, after conducting further investigation pursuant to an earlier court direction, filed a third supplementary final report stating that no fresh evidence has emerged indicating the involvement of any additional accused.
Holding that the petition lacked merit, the Principal Special Judge dismissed Dr. Sunita’s plea.
