VISAKHAPATNAM: The XV Additional District and Sessions Judge in Visakhapatnam issued a non-bailable warrant against Paul Dean, an Australian citizen for not appearing in the court for disposal of his criminal appeal.

Earlier, he was convicted by the Railway Court for the crimes he committed against children, violation of Foreigners Act and Passport Act and filed a criminal appeal in the XV Additional District and Sessions Judge.

According to assistant public prosecutor K Partha Saradhi, the judge in his order said the accused was very much present in Visakhapatnam near RK Beach and that he was not attending the court intentionally. In fact, while granting suspension of sentence this court-imposed conditions to prosecute the case in proper manner.

This appeal matter pertains to year 2018 and originally the crime relates to year 2001, but the appellant/accused was not coming forward to prosecute the matter taking advantage of suspension of sentence passed by this court in his favour, the prosecutor said quoting the judge.

In these circumstances this court felt that it was just and necessary to issue a non-bailable warrant to secure the presence of the appellant/accused for disposal of this appeal in his presence on merits since he violated the conditions imposed by this court, the APP added.

It may be recalled that the railway court in Visakhapatnam in March 2018 sentenced the 75-year-old Dean to three years simple imprisonment under Sections 377, 292 (2) (A) of IPC and Section 12 of Passport Act 1967 and Section 14 of Foreigners Act and slapped a fine of Rs32, 000.

He was convicted and sentenced based on the statement of the lone witness and victim David, a blind man, who was in his teens when the crime was committed. After getting bail, Paul later challenged the decision in the appellate court, second additional district judge court.

Paul was arrested from his RK Beach apartment in Visakhapatnam in August, 2001after his exploits were published in these columns.
