Insulting “Vande Mataram” a punishable offence
NEW DELHI: Union home minister Amit Shah is set to introduce the Prevention of Insults to National Honour (Amendment) Bill, 2026, in the Rajya Sabha on Monday, seeking to extend legal protection to the national song “Vande Mataram”.
The proposed amendment aims to accord the national song the same statutory safeguards as the National Anthem, “Jana Gana Mana”. The Bill has been cleared by the Union Cabinet and has been listed in the Rajya Sabha for consideration and passage.
Once enacted, the legislation will amend the Prevention of Insults to National Honour Act, 1971, to make insulting “Vande Mataram” a punishable offence, placing it on par with the National Anthem.
Under the provisions, a person found guilty of intentionally insulting or obstructing the singing of the national song could face imprisonment of up to three years, a fine, or both.
The 1971 Act currently provides protection to the National Flag, the Constitution of India and the National Anthem against acts of intentional disrespect. The amendment expands its scope to include “Vande Mataram”.
On July 9, the Union home ministry directed all states and Union Territories to play “Vande Mataram” before the National Anthem at official functions.
Earlier this year, the government announced a nationwide campaign to mark 150 years of “Vande Mataram”, recognising its role in the freedom movement.
Government ministries, educational institutions and public bodies have been encouraged to organise cultural programmes, discussions and events highlighting the song’s contribution to the independence struggle.
