Chennai: Following the submission of the Commissioner of Police that the request from the DMK to conduct a human chain protest on July 27 has been rejected, the Madras high court has dismissed as infructuous, a PIL, which sought a direction to the CoP not to permit the DMK from holding the protest against Neet examination on July 27.
A division bench comprising Chief Justice Indira Banerjee and Justice M. Sundar dismissed the PIL from M.R. Saravanan, a social activist and former president of South Chennai, Human Rights Federation.
In its order, the bench said this writ petition styled as a public interest litigation has been filed seeking a direction to the Commissioner of Police not to permit the DMK political party from holding any strike, demonstration, dharna, human chain protest on July 27 in relation to the Neet.
Counsel appearing on behalf of the petitioner submitted that any protest against Neet would be against the judgment of the Supreme Court. Additional advocate general C. Manishankar on instructions submitted that permission to hold protest has not been granted by an order dated July 25, 2017, of the commissioner of police.
“There can be no doubt that if there is any illegal activity action would have to be taken. However, an order cannot be issued in anticipation. The petition has become infructuous by reason of the order refusing to grant permission to the party concerned to hold the protest”, the bench added.
