Rebel MP's release from custody likely to be delayed
VIJAYAWADA: YSR Congress rebel MP K. Raghu Ramakrishna Raju’s release from judicial custody may be delayed by three to four days until his health condition improves.
When the MP’s lawyers arrived at the 6th additional civil junior judge court in Guntur to submit sureties for his release on bail on Monday, the in-charge magistrate asked for the MP’s discharge summary from the Military Hospital in Secunderabad where he is undergoing treatment. The doctors informed that it would take up to four days for him to improve.
The lawyers said that once the discharge summary is submitted in the court, it would accept the bail bond of Rs 1 lakh and two sureties of like amount. The court would then issue a release order for the MP from judicial custody.
As per norms, the Guntur district jail authorities have to get the signature of the MP on the bail bond, which means that he has to be brought to the jail from the hospital.
His lawyer V. Lakshmi Narayana said, “As per the magistrate’s direction, we are waiting for the discharge summary from the hospital, where he is presently undergoing treatment. According to the Supreme Court, sureties can be submitted in the court for getting release order from the jail within 10 days of discharge from hospital.”
Meanwhile, it has to be seen whether the Guntur district jail authorities insist on the MP to be physically present in the jail to sign on the bail bond to get released technically from the jail as his stay at hospital is considered as judicial custody. There may also be a chance for the MP to be released on bail from the hospital itself.
Meanwhile, the Supreme Court is to hear the petition filed by the MP’s son Bharath on Tuesday, seeking CBI probe on charges of sedition booked against the MP by the APCID, his arrest, ill-treatment and medical report given by the government general hospital in Guntur giving clean chit on his health condition after interrogation by CID sleuths.
