Marketing Federation Limited division valid, rules Hyderabad HC

The petitioners contended that bifurcation of state was done in March 2014 and the order in May to divide federation was illegal.

Hyderabad: A division bench comprising Acting Chief Justice Dilip B. Bhosale and Justice P. Naveen Rao of the Hyderabad High Court has ruled division of the Andhra Pradesh Marketing Federation Limited in May 2014 was legal and the Telangana state government has the power to appoint its in-charges.

The bench was dismissing a batch of petitions challenging the division of the federation in May 2104 and consequently appointing in-charges by the TS government. The petitioners contended that bifurcation of state was done in March 2014 and the order in May to divide federation was illegal.

The bench pointed out that though the erstwhile state stood bifurcated from June 2, 2014, the President gave his assent to the Reorganisation Bill in March 2014, and thus the division was valid.

The petitioners, all elected directors of the federation urged the court to declare its division illegal and as they were elected for a five-year term, allow them to continue in the office till expiry of their term. The bench said that since the division and appointment of in-charges was done in accordance with the law, the petitions were devoid of merit.
