Supreme Court stays work on towers in Banjara Hills
Hyderabad: The Supreme Court has directed the TS government not to take up any construction activity for a period of at least two weeks at the disputed site of the proposed Police Command Towers in Banjara Hills of the city.
A two-member bench, comprising Justice Jagdish Singh Khehar and C. Nagappan was disposing of a special leave petition filed by Mir Afsar Ali and 16 others, challenging the order of a division bench of the Hyderabad High Court vacating the stay granted by a single judge.
The petitioners, claiming possession of five of the eight acres allocated for the Command Centre, had applied to the principal revenue secretary in 2007 seeking regularisation of the land in their names. Their application was rejected on April 30, 2007.
They moved a plea before a single judge, who granted an interim stay on the ground that the impugned order of the principal secretary was bereft of reason and cryptic.
Aggrieved by the single judge order, the state government moved an appeal before the division bench which vacated the stay.
On Friday, ASG Paramjit Singh Patwalia, appearing for TS, informed the court that no construction will be carried out at the disputed site till the revenue authorities pass an order on the appellants’ application for regularisation of the land in their names.
The bench, while recording the statement of the ASG, observed: “We are satisfied that the petitioners stand substantially protected. We consider it just and appropriate to further direct that no construction shall be made for a period of two weeks, after communicating the speaking order to the petitioners.”
