Chennai: The Madras bench of Central Administrative Tribunal has directed authorities in Engine Factory Avadi (EFA) to consider the representation of a Principal medical officer (SG) not to transfer him to Nilgiris from EFA.
In the petition, Dr R. Tamil Sudar, submitted that he was serving as Principal Medical Officer (SG), in Engine Factory Avadi (EFA), Avadi. He was transferred from ordnance factory Tiruchirapalli to Heavy Vehicles Factory, (HVF) Avadi, on April 30, 2013, and within a short period of time, he was again transferred from HVF, Avadi to Engine Factory Avadi on January 31,2014. While so, all of a sudden, he was transferred to Cordite Factory, Aravankadu, Nilgiris.
Tamil Sudar said he was looking after his aged mother and daughter. His mother was 80 years old and suffering from breast cancer. She underwent surgery in 2015 and was on medication. She was unable to move and due to old age could not stay in high altitude area. His daughter was suffering from Club Foot disorder and 60 per cent disabled. He was bronchial asthma patient. Transferring him to the hill station would adversely affect his health and health of his family members.
He was transferred three times in three years. He sought quashing of the transfer order. Regarding this, he sent a representation on January 18, 2017 to the Chairman and DGOF, Ordnance Factory Board, Kolkata. General manager, Engine Factory Avadi (EFA) and General Manager, Cordite Factory, Aravankadu, Nilgiris.
In the petition, he sought the CAT to quash the transfer order. Considering his plea, the bench comprising judicial member K. Elango and administrative member Dr P. Prabakaran directed the authorities to consider his representation in letter and spirit and pass an appropriate order in accordance with law within a period of one month. Till the disposal of the representation, status quo in respect of the applicant alone against the impugned order dated January 16,2017 is maintained, the bench said.
