Tainted' members may face legal challenges
Hyderabad: Terming the nomination of some of the members to the TS Wakf Board as “highly irregular and suspicious”, social activists have decided to challenge the appointments by filing a writ petition in the High Court.
Md. Ilyas Shamsi, who heads the Peace and Development Forum, said, “The procedure adopted for conducting election to constitute the TS Wakf Board is violative of the provisions of the Wakf Act 1995 as amended by Act 27 of 2013 and is also contrary to the Wakf Rules and Regulations of 2000.”
Mr Shamsi said that the TS government issued notification for election of the Board members but failed to specify the composition of the Board to be constituted, i.e., total number of members, including the nominated members.
“Location where the nominations were to be filed was not specified. In fact the entire electoral process was not specified, as statutorily required under Election Rules,” he said.
Wakf activist M.A. Samad said, “In provisional electoral rule the name of Syed Shah Ali Akbar Nizamuddin Hussaini is mentioned as Mutawalli of Dargah Hazrat Peera Hussaini, Afzalgunj, and Dargah Hazrat Shah Khamoosh. Both these institutions were under the direct management of the Board for over two years. Just a few days before the issuance of the election notification, Akbar Nizamuddin was reinstated without financial powers.”
“Wakf Board neither prepared a Budget nor maintained accounts for that institution; how then did the Board assume that the income of the institution is '1 lakh or more?” Mr Samad said.
