Case against N Chandrababu Naidu can't be quashed, HC told
Hyderabad: P. Sudhakar Reddy, counsel appearing for YSR Congress MLA Alla Ramakrishna Reddy in the cash-for-vote case told the Hyderabad High Court on Tuesday that there was no provision under the law to either to stay or quash the case registered under the Prevention of Corruption Act.
Counsel was continuing his arguments on the second day before Justice T. Sunil Chowdary in a criminal petition moved by AP Chief Minister N. Chandrababu Naidu, challenging an order of the ACB Court ordering a probe into the role of other accused in the case.
He told the court that there was no need of issuing an FIR against the petitioner in this case based on the order issued by a Special ACB Court under Section 156(3) of the CrPC on the complaint of Mr Ramakrishna Reddy.
Differing with the argument of counsel for Mr Naidu that the ACB compelled the second FIR by virtue of the special court order, he said that the PCA empowered a preliminary inquiry without issuing the FIR.
He reminded that the Supreme Court had declared that the exercising vote is a part of public duty. The arguments will continue on Wednesday.
