Students move Hyderabad High Court on regularisation decision

The bench issued notices asking the respondents to spell out their stand through counter affidavits and posted the case to June 10.

Hyderabad: The decision of the TS government to regularise the services of contract lecturers has come under the judicial scanner.

Nakka Govinda Reddy and 23 others, all students of Osmania University, moved the Hyderabad High Court questioning the decision.

The TS government had issued GO Ms No. 16 dated February 26, 2016 adopting Regularisation of Appointments to Public Service and Rationalisation of Staff Pattern and Pay Structure Act 2 of 1994.

While adopting the Act, the government added a new Section (10A) as per power conferred on it under Section 101 of the AP Reorganisation Act, 2014 to regularise the services of contract lecturers working in government colleges in the state.

P.V. Krishnaiah, counsel for the petitioners, argued before a division bench comprising Acting Chief Justice Dilip B. Bhosale and Justice P. Naveen Rao that an Act cannot be amended thorough an executive order. The Legislative Assembly is only competent authority to amend the Act.
