Odisha govt issues new guidelines for appointing kin of deceased employees

Bhubaneswar: The Odisha government has introduced revised guidelines for processing compassionate appointment cases, providing clarity on pending applications. A notification issued by the General Administration and Public Grievance (GA&PG) Department on Friday outlines the new approach.
As per the notification, all pending cases where a government employee passed away before the Odisha Civil Services (Rehabilitation Assistance) Rules, 2020 came into effect will be handled according to the rules that were in force at the time of death of the employee.
For deaths occurring between the commencement of the 2016 Amendment Rules and before the 2020 Rules came into force, the provisions of the Odisha Civil Service (Rehabilitation Assistance) Rules, 1990 will apply.
In cases where the government employee died before the 2016 Amendment Rules, appointments will be processed based on the distress certificate available in the original application, again under the 1990 Rules.
Further, for deaths that occurred between the implementation of the 2010 Amendment Rules and the 2020 Rules, the appointing authority must now verify the family’s current financial situation. This will be done by obtaining a report from the district Collector to determine if the family qualifies as financially distressed, as per Rule 8 of the 1990 guidelines.
The key change lies in using the date of death as the deciding factor for which rules apply, rather than the date when the application was considered.
Sharing his thoughts on the development via his official ‘X’ handle, Advocate General Pitambar Acharya remarked, “The Odisha Government’s decision to treat the date of death as the reckoning date in compassionate appointment cases is historic. It will resolve hundreds of long-pending cases in the Supreme Court and Orissa High Court.”
