Kerala High Court insists on closure of Malaparambu school

The court was considering a contempt of court petition alleging non-compliance by the AEO with the directions of the court.

Kochi: Kerala High Court on Friday asked the state government to arrest and remove the persons who are obstructing the implementation of the court order in the Malaparamba AUP school issue. Justice A.K. Jayasankaran Nambiar impleaded the home secretary, state police chief, district collector, Kozhikode, and city police commissioner, Kozhikode, in the case and asked them to assist the AEO, Kozhikode, to implement the High Court order.

The court, which posted the case to June 8 for further hearing, impleaded the authorities after the AEO expressed her helplessness in complying with the court order. “An obstruction to the implementation of the orders of the High Court is nothing but a challenge to the effective functioning of a democratic institution and an affront to the concept of rule of law, which gives our nation its identity as a republic,” it said.

The court was considering a contempt of court petition alleging non-compliance by the AEO with the directions of the court. The court had ordered closure of the school on finding that the state was not inclined to take over the management of the school. The court made it clear that it would not be a silent spectator to wilful acts of disobedience in respect of the orders passed by it.
