Hand over copy of chargesheet relating to laying siege to CJ's house to Bar Council

A case of trespassing was registered by the police and six advocates were arrested in the case.

Chennai: The Madras high court has directed the XI Metropolitan Magistrate, Saidapet, before whom the chargesheet in the case relating to advocates allegedly laying siege to the official residence of Chief Justice Sanjay Kishan Kaul here, over an anticipatory bail issue and creating ruckus on April 2, 2015, is filed by the police, to hand over a copy of the chargesheet, after taking it on record, to the State Bar Council, which is the statutory body to take action against lawyers for their misconduct.

A division bench comprising Chief Justice Sanjay Kishan Kaul and Justice R.Mahadevan gave the directive while closing a petition from advocate Elephant G.Rajendran, which sought a direction to the police to file a status report with the name of the persons who instigated the lawyers to do these illegal acts.

When the petition came up for hearing on November 24, after perusing the compliance report filed by the investigating officer, the bench said, “We have perused the compliance report and charge sheet is stated to have been filed before the XI Metropolitan Magistrate, Saidapet, on November 23.

“The final report has been produced before this court. In terms of the same, there are two accused stated to be absconding, while the identity of some more accused is yet to be established, for which evidence is being collected. On the magistrate taking the charge sheet on record and numbering it, a copy of the same be handed over to the state bar council”.

On April 2, 2015, a group of lawyers allegedly barged into the official bungalow of Chief Justice Sanjay Kishan Kaul at Greenways Road when he was in Delhi attending a conference of chief justices and chief ministers, and laid siege to it demanding immediate hearing of petitions seeking anticipatory bail for two advocates.

A case of trespassing was registered by the police and six advocates were arrested in the case. In his petition, Rajendran submitted that the BCI had suspended lawyers for misconduct.

However, though he gave a representation to the BCI to take action against advocates involved in laying siege to the house of the Chief Justice, no action was taken because of the involvement, influence and interference of some member of the All India Bar Council and Bar Council of Tamil Nadu, he alleged.
