Kerala High Court quashes case against Lakshmi Nair
Kochi: Kerala High Court on Friday quashed a case against former principal of Kerala Law Academy Lakshmi Nair, accused in case related to the castiest remarks against a student belonging to scheduled caste, after the student withdrew all the allegations. “I withdraw all the allegations against Lakshmi Nair to constitute the offence SC/ST Act. I am not a member of 'Pulaya' community. I am continuing my studies in the college and there is no pressure or undue influence from the part of Lakshmi Nair or from the management of college," stated in the affidavit submitted by VG Vivek.
Vivek also gave consent to quash the criminal proceedings against Lakshmi Nair. Vivek has given statement before the investigating officer retracting from his earlier stand to withdraw the case. The Peroorkada police had registered complaint against Laksmhi Nair based on a complaint by VG Vivek, an AISF activist, a student leader during Law Academy strike. The police booked her under section 3 (1) (s) of Sc and ST (Prevention of Atrocities) Act. On Friday, Vivek personally appeared before the court and informed that the allegation was withdrawn on removal of Lakshmi Nair from the office of principal on settlement of all issues with the agitating students.
Lakshmi Nair submitted that no purpose served in continuing with the investigation and charge sheeting her in the case. The complainant unconditionally has withdrawn the case. Hence, the continuance of criminal proceedings is an abuse of process of law, Lakshmi Nair said. Recording the affidavit of Vivek, the court quashed further proceedings against Lakshmi Nair.
