Wagamon case: SIMI plea for jail in Kerala

Eight SIMI activists, who escaped from the Central jail here, had been killed in police encounter at Malikheda near Bhopal.

Kochi: Eleven accused persons in the Wagamon SIMI secret case, currently lodged in Bhopal Central Prison, have approached Kerala High Court seeking their transfer to jails in the state in the wake of recent killing of eight Maoists in Madhya Pradesh. Eight SIMI activists, who escaped from the Central jail here, had been killed in police encounter at Malikheda near Bhopal.

The petition was filed by Shaduly, Hafiz Hussain, Safdar Hussain Nagori, Shibili P Abdul Karim, Mohammed Anzar, Amil Parvez, Kamaran Siddiqui, Mohammed Yasir, Kamaruddin Nagori, Mirza Ahamad Beg and Mohammad Abu Faizal Khan.
Shaduly, Hafiz Hussain, Safdar Hussain Nagori and Shibili P. Abdul Karim and Mohemmed Nazar were undergoing imprisonment in the Central Prison in Vyuur in the Panayikulam case and they were transferred to Sabarmathy Jail in connection with the Ahmadabad blast cases.

The Panayikulam case pertains to a secret meeting of the banned outfit at Panayikulam, in Aluva in Kochi, on August 15, 2006. At that time, five accused in the Wagomon case were already in the Sabarmathy jail. While the trial in the Wagomon case was progressing through video conferencing, all the accused were transferred from Sabarmathi prison to the Bhopal Central Prisons.

Petitioners pointed out that in Bhopal Central prison,there was a shooting and death of eight alleged SIMI activists. The petitioners were treated cruelly and harassed and tortured in Bhopal jail.They were denied their basic needs and facilities. Petitioners were very much anxious and worried about the health of petitioners in the background of unfortunate event.

The petitioners being under trial prisoners in Wagamon case, they preferred to have their custody in Kerala to enable them to effectively concentrate and participate in the trial. They had a right to have a trial in the their presence and that could not be denied on the ground that they were convicted by another court of another state. The petition stated that among the petitioners three are from Kerala. Their family will get opportunity to meet them if they are accommodated in a jail in the state.
