Kerala High Court seeks medical report of Swami Gangeshananda

The petitioner argued that the statement of the victim woman was unbelievable.

Kochi: The Kerala High Court on Tuesday asked the police to produce the medical report of swami Gangeshananda, whose vital organ was cut off by a woman when he attempted to rape her. The court, which was considering a bail petition filed by Gangeshananda, adjourned the plea to July 27. The petitioner argued that the statement of the victim woman was unbelievable. The investigation of the case was now with the Crime Branch and there were no materials to support the allegation that the petitioner committed rape.

The only material against the accused is the first information report and the abetment charge under section 164 of CrPC before the magistrate. When the statement in the first information report is disowned by the informant herself, there was absolutely no material to implicate the accused in the crime. Hence, the petitioner may be granted bail, he argued. The police custody of the petitioner was completed and he has been in judicial custody for more than two months, the petition stated.
