Chennai Corporation spares errant staff, but police blames them
Chennai: The Chennai corporation and the police have filed two contradictory reports before the Madras high court, fixing the responsibility on persons for the death of a 3-year-old-boy, who fell into the manhole and died on June 15, 2013, in Taramani. While corporation dropped the charges against an assistant engineer and a road worker, the police fixed the responsibility on them.
Following the death of three-year-old boy Dinesh, social activist Traffic Ramaswamy filed a PIL in the Madras high court to take action against the officers for the mishap and also to pay compensation to the family of the deceased.
When the case came up for hearing on July 4, 2016, before a division bench headed by Chief Justice Sanjay Kishan Kaul, it was submitted that a criminal case has already been filed on account of death of the child against two officials and disciplinary proceedings were also pending. Recording the same, the bench directed the authorities to file status report and posted the matter to October 17.
Accordingly when the case came up for hearing on Monday, the Commissioner, Chennai Corporation and the Additional Commissioner of police filed their reports separately.
In his report, Chennai corporation commissioner D.Karthikeyan submitted that D.Gopalakrishnan, a road worker and assistant engineer G.Logeswaran were suspended after the incident. After examining their explanations and completion of the enquiries, the charges framed against them were dropped. Similarly, after examining the explanation given by assistance executive engineer P.Mohan, the charges framed against him were dropped, he added.
However, in his report, Abhay Kumar Sing, the additional commissioner of police submitted that during investigation it was found that G.Logeswaran, assistant engineer and T.Gopalakrishnan, road worker, were responsible for the death of the said boy due to their negligence of duty. Hence, the section registered in the case was altered from 174 cr.p.c to 304 (A) of IPC. The case is under investigation, he added.
