Madras HC upholds life term for acid attacker
Chennai: The Madras high court has upheld an order of a lower court, convicting and sentencing an accused to life imprisonment for throwing acid on a young girl in Adambakkam on January 30, 2013 due to alleged strained love relationship, which ultimately resulted in her death.
A division bench comprising Justices S. Nagamuthu and V. Bharathidasan dismissed the appeal filed by the accused Vijay Bhaskar, challenging the order of the Principal sessions judge, Kancheepuram in Chengalpattu, awarding life sentence to him.
According to prosecution, the police arrested Vijay Bhaskar (31) for throwing acid on one Vidya (21) at a local browsing centre in Adambakkam, where she was working. Despite treatment at Kilpauk Medical College Hospital, she died on February 24, 2013.
In his appeal, among other things, the accused contended that the evidence of three prosecution witnesses – one, the mother of the deceased and the other two, who were closely interested in the affairs of the deceased – should not be given credence. Their presence at the crucial point of time was highly unbelievable, he added.
Concurring with the submission of Additional public prosecutor M. Maharaja, the bench said the dying declaration was given in a fit state of mind by the vitim. “This dying declaration is in conformity with the statement recorded by the police.
Thus, the prosecution has clearly established that it was the accused who threw acid, which ultimately resulted in her death,” the bench added.
