Chennai: Senior counsel K. Doraisamy, also a former public prosecutor of the Madras high court, while arguing the case pertaining to the property of Pachaiyappas trust, which are leased out to Muhuthaam Event Management Pvt.Ltd, before Justice R.Suresh Kumar, suddenly became emotional and at one stage broke down on Monday.
Replying to the submissions of senior counsel A.L. Somayaji that the applications filed questioning the lease granted to Muhuthaam Event Management are not maintainable, senior counsel K.Doraisamy said all the persons interested in the welfare of the trust can file any application and there is no need to file a separate suit.
He said the object of Pachaiyappas trust is to promote education in the state. Besides, education, the founder of the trust has contributed donation to almost all the temples in Tamil Nadu particularly the Chidambaram Natarajar Temple. In his Will, he has made a provision to provide salary for the teachers who teach English. The authors of very prominent text books in various subjects are professors from Pachaiyappas college. The funds were meant for education purpose only. But now, the funds were being diverted, he alleged.
He said the trust has invested several crores for constructing the two multi purpose halls, deviating from the object of the trust. If they were going to collect the meagre rent, they cannot repay the loan obtained for the construction of the buildings. Therefore, the applicant has filed the present applications to cancel the lease deed, he added.
Stating that the two Kalyana Mandapams which were built without any permission from authorities have to be demolished and the cost of the construction has to be recovered from those responsible for it, besides launching criminal prosecution against them, senior counsel K.Doraisamy suddenly became emotional and said, “Pardon me for being emotional. I came from a village and do not know anyone here. I had no one to support me. But, this great institution gave me support, protection and education. I stayed in the hostel and studied. Now, I am standing here before you ‘My Lord’ as a senior counsel and arguing the case. I appeared for this great institution (Pachiappas) free of cost on earlier occasions. Now also I am appearing for free of cost. I want to save the institution. The interest of the institution has to be safeguarded. I have no other way to show my gratitude and repay the debt.”
