The petitioner\'s contention was that the GO No. 317 does not speak about the spouse
Hyderabad: The Telangana High Court is not inclined to stay the operation of GO No. 317, which is for allotment of staff to new local cadre guidelines, which is allotment of persons holding posts required to be organized in local cadres.
A division bench comprising Chief Justice Satish Chandra Sharma and Justice N. Tukaramji was dealing with a writ petition filed by one female school assistant working in Rajiv Gandhi Nagar, Saroornagar, who was aggrieved by the GO. The petitioner's contention was that the GO does not speak about the spouse, working in Central Government and sought a stay on it.
Special government pleader A. Sanjeev Kumar informed the court that earlier there were 10 districts and today the figure has touched 33 districts and the distance between the main district and the new districts were not much.
The bench observed ‘a person from Kerala is working in Siachen where the temperature is minus 40 degrees Celsius and in this present case, the distance between the main district and the new district which is carved out of the main district is not much , and on this ground, the court cannot stay the operation of GO.317. It is a policy decision. It is unfortunate to come to the court on these grounds.’
Further, the bench, turning towards Sanjeev Kumar, said in a lighter vein, “why don’t you open offices in the residential areas of employees. Why are you harassing them?”
