Land Allotment to a Few Communities Questioned

HYDERABAD: A two-judge bench of the Telangana High Court issued notices in a PIL questioning the allotment of land measuring six acres and 35 guntas in Survey No.41/14 at Khanamet village to Viswa Balija, Kapu, Thelaga, Vontari, Thurpukapu, Sangala Samakya for the construction of Community Bhavan.

The bench comprising Chief Justice Alok Aradhe and Justice J. Anil Kumar is dealing with a PIL filed by Sunkara Naresh, a practising advocate in the High Court.

The petitioner complained that the land in question has been allotted at a throwaway price of Rs 100 per acre which is arbitrary. The petitioner would contend that the land around the Hi-Tec City would cost approximately more than Rs 100 crore per acre and apparently the allotment is for the construction of community bhavan to run the affairs of respective castes and not for any educational institutions or social causes.

The petitioner would also contend that in the subject locality, another piece of land was allotted to another association for construction of a community hall and a Division Bench of the Court by way of an interim order had stayed the order of allotment. The bench observed that in the instant case, the construction has already commenced and without hearing the other side, it is inclined to grant an ad interim order, the Chief Justice said.

Commercial use in residential area challenged

Justice T. Vinod Kumar of the Telangana High Court on Thursday admitted a writ petition challenging provisional permission granted for the commercial usage at a residential area in Banjara Hills.

The judge is dealing with a writ plea filed by Kommareddy Sravan Kumar challenging an illegal construction and provisional permission to sublet it for commercial usage.

It was argued by the petitioner that initially the building permission was granted in favour of PetraRock, a real estate company, and now in a residential area, Deputy Commissioner of GHMC had granted the provisional permission to sublet it for commercial usage to a third party.

It was also argued that the ownership rights of the said property are disputed. The judge after perusing the records pointed out that the construction had already been completed, and any injunction on the same cannot be granted. The court admitted the writ petition and posted the matter after two weeks for further proceedings.

HC directs PG law college to reserve one LLM seat

Justice S. Nanda of the Telangana High Court directed a seat for an LLM candidate to be reserved at Post Graduate College of Law at Osmania University, Basheerbagh.

The judge is dealing with a writ plea filed by Y Soma Srinath Reddy complaining that the convenor, Lawcet, has failed to allot an LLM seat to the petitioner as per the web options selected in either of the colleges for the course of constitutional law, criminology, and criminal justice system in University College of Law, OU Campus, and constitutional law and crime and torts in Post Graduate College of Law, Osmania University, Basheerbagh, following merit and detailed notification issued on November 11 by convenor, TS-Lawcet.

The petitioner alleged that such an action of the officials is illegal and arbitrary. The petitioner also sought a seat be allotted to him as per the merit and the notification issued on November 11. The judge had earlier issued notices and directed to file counters. As no counters were filed, the judge directed to reserve one seat in the course of constitutional law in Post Graduate College of Law Osmania University Basheerbagh until further orders.
