Teacher transfer: Counselling from comprehensive list

The secretary to government, education department must ensure the authenticity of the list of vacancies.

Chennai: Pointing out that the provision made for administrative transfer in the Government order for teacher general transfer counseling is without any guideline, the Madras high has issued a set of guidelines for general transfer counseling, including transfers on administrative grounds, which would be in operation till appropriate orders are issued by the government incorporating these guidelines.

A division bench comprising Justice K.K. Sasidharan and P.D. Audikesavalu gave a set of 21 guidelines while disposing of a Public interest litigation from K.K. Ramesh which sought to direct the authorities to order Directorate of Vigilance and Anti Corruption to conduct enquiry regarding the huge amount of bribe and irregularities and violations committed before and after the teacher general transfer counseling in 2018 in all districts.

Among other things the set of guidelines included the one that the annual transfers including the vacancies due to promotion/upgrading of schools must be only on the basis of general counseling, the education department should issue the G.O for general counseling sufficiently in advance and at least by May 15 of the relevant year, the concerned authority should publish the list of vacancies as on June 1 in education department website.

The entire vacancies should be shown in clear terms. The general counseling should be only from the comprehensive list published by the education department.

The secretary to government, education department must ensure the authenticity of the list of vacancies.

There should be a gap of minimum ten working days between the date of publication of vacancies and the actual date of counseling and the authorities must also publish the approved panel for promotion at all level, before the commencement of the counseling process.
