Two-member panel to look into all Asman Jah Paigah pending cases

HYDERABAD: The Telangana High Court appointed retired district judges Ajithsimha Rao and Mohammed Bande Ali as receiver-cum-commissioners in the pending cases related to civil suit.No.7 of 1958 that was filed by the legal heirs of Asman Jah Paigah and others.

The commissioners have to submit a comprehensive report by March 6 to the High Court.

Based on the report, the High Court may consider drawing up the final decree in CS 7 case lands, which are spread over thousands of acres in Miyapur, Raidurg, Shamshiguda, Kukatpally, West Marredpally and Balanagar.

As there has been no final decree, various parties, including the state government, are fighting for ownership of huge extents of land worth thousands of crores of rupees. The cases took curious turns with several judicial orders conflicting with each other.

Third parties who claim ownership through purchase of shares from the original defendants (legal heirs) succeeded in obtaining orders in some cases. However, most of the cases are pending before the High Court and with many lagging behind without any final decree, the High Court recently constituted a special bench to deal with all those cases.

The special bench headed by Chief Justice Ujjal Bhuyan and Justice N.V. Shravan Kumar opined that when the land in question is a subject matter of C.S.No.7 of 1958 which is pending, the question of any party seeking registration of the document or any such relief did not arise. The court also made it clear that if any such order had been passed by any authority, the same would be redundant.

Further, it said that the parties to the suit or their legal representatives would have to abide by the final decree that may be drawn up on the basis of the report of the receivers-cum-commissioners.
